Terms and conditions of use
Last updated: 13 August 2026. This document constitutes the contract governing access to and use of the WayFy platform and is complemented by the Privacy Policy. Please read it carefully before using the Service.
1. Purpose and acceptance
These Terms and Conditions (hereinafter, "the Terms") govern access to and use of the WayFy platform (hereinafter, "the Service" or "the Platform"), owned by WayFy (hereinafter, "WayFy"), by registered or unregistered users (hereinafter, "the User").
Accessing or using the Service, in any of its features, implies full and unreserved acceptance of these Terms and of the Privacy Policy. If the User does not agree with the entirety of its content, they must refrain from using the Service.
2. Description of the service
WayFy is a digital trip-planning platform aimed at people with reduced mobility or specific accessibility needs. The Service includes, among others, the following features:
- An interactive map with accessibility information from OpenStreetMap and contributions validated by the user community.
- A day-by-day trip planner, with itineraries, visit times, route drawing —including a route calculated for wheelchairs—, exporting the day in GPX format, and navigation links to the device's maps app.
- Publishing accessibility reviews, photographs and ratings for places.
- Proposing new places for the map, subject to a moderation process by the administration team before general publication.
- Managing favourites, organisable with custom tags.
- A friends system, public profiles, and real-time direct and group messaging, end-to-end encrypted (see clause 5).
- Notifications about social and moderation activity, configurable by the User on the web and email channels.
- Publishing and exploring public trips created by other users.
- An AI assistant to support trip search and planning.
AI assistant. The assistant's replies are generated automatically by an external provider's language models and may contain errors or outdated information. They are purely indicative, do not constitute advice of any kind, and do not replace direct verification by the User.
WayFy reserves the right to add, modify or remove Service features at any time, without this giving rise to any right to compensation for the User, except where required by law.
3. Registration and user account
Access to the accessibility map is public and requires no registration. The rest of the Service's features (favourites, trips, reviews, messaging, etc.) require creating an account. By registering, the User declares and warrants that:
- They are over 16 years old, or have the express consent of their legal representative for the processing of their personal data.
- The information provided at registration is truthful, accurate, and will be kept up to date.
- They will keep their access credentials confidential and, where applicable, their two-factor backup codes, and are responsible for all activity carried out from their account.
- They will notify WayFy without undue delay of any unauthorised use of their account or security breach they become aware of.
Registration can be completed with a personal password or via a Google account. In the latter case, the User authorises WayFy to receive from Google the minimum identifying data needed to create the account, and access is additionally subject to that provider's terms. Revoking permission from the Google account may prevent access through that route.
Access to the account can also be done via a one-time code sent to the registered email address. The User is responsible for keeping control of that mailbox: whoever accesses it will be able to sign in to the account.
WayFy reserves the right to temporarily suspend or permanently cancel accounts that breach these Terms, without prejudice to any legal action that may be applicable. It may likewise temporarily suspend new registrations for technical or security reasons.
4. User-generated content
"Content" is understood to mean any review, photograph, proposed place, trip, comment, chat message, or any other contribution the User publishes on the Platform. By publishing Content, the User declares and warrants that:
- They hold the intellectual property rights to that Content, or have the necessary permissions to publish it.
- The Content is truthful, in particular information relating to the accessibility of the places described.
- The Content does not infringe third parties' intellectual property, industrial property, honour, privacy or image rights, nor applicable law.
- The Content is not defamatory, discriminatory, violent, sexually explicit, or constitutes harassment.
By publishing Content, the User grants WayFy a worldwide, non-exclusive, royalty-free licence to store, reproduce, display and distribute that Content within the Platform, for the sole purpose of providing the Service. The User may delete their Content at any time from their profile, without prejudice to the provisions of clause 11.
Public content and indexing. By marking a trip as public, the User accepts that its title, description, itinerary, cover image, and their own name and avatar become accessible to anyone, are included in the site's sitemap, and are reported to search engines that support the IndexNow protocol. When that status is withdrawn, WayFy stops showing the trip and notifies search engines again, although it does not control their index update schedules or any cached copies they may temporarily keep.
Accessibility reviews and photographs are published without prior review and are moderated afterwards. WayFy may remove Content that breaches these Terms at any time, following assessment by the administration team.
Places proposed for the map by a User remain visible only to their author until an administrator reviews them and, where applicable, approves them for general publication or rejects them, with reasons given, without this giving rise to any right to compensation.
Sharing on WayFy's social media. When the User marks a trip as public or proposes a place for the map, they may additionally authorise, via a specific checkbox, WayFy to share that Content on its official Instagram and Facebook profiles. This authorisation is voluntary, does not condition use of the Service, and extends the licence in this clause solely to reproducing the title, description, cover image and public link of the Content on those profiles. Publication is not automatic: it requires prior review by an administrator. The User can withdraw the authorisation at any time from the trip's edit screen, which will prevent new posts; posts already made must be requested through the contact channels, as they are hosted on third-party platforms subject to their own terms.
5. End-to-end encrypted messaging
Chat messages, both direct and group, are encrypted on the User's device and can only be read on the recipients' devices. WayFy holds the User's private key in encrypted form, but has no means whatsoever to decrypt the messages. This has the following consequences, which the User expressly accepts:
- Unlocking the encryption requires an access key (passkey) or the recovery code given when this feature is enabled. Safekeeping it is the User's sole responsibility.
- Losing all unlock methods results in the permanent and irreversible loss of the message history. WayFy cannot restore it, and the User is warned of this during the activation process itself.
- Resetting the encrypted identity generates new keys and renders previous messages unreadable.
- WayFy cannot moderate the content of private conversations. Reports of harassment or other prohibited conduct will be assessed based on the information provided by the reporting party, and may lead to suspension or cancellation of the offending account under clause 7.
6. Accessibility information, routes and navigation
The accessibility information available on WayFy comes from two sources: OpenStreetMap's collaborative data, published under the Open Database License (ODbL)licence, and contributions from the WayFy user community. WayFy does not individually verify each piece of accessibility data and therefore does not guarantee its accuracy, completeness or currency.
The User acknowledges and accepts that the information shown is indicative in nature and it is recommended to check directly with the venue before visiting. WayFy will not assume any liability for damages arising from decisions made on the basis of outdated, incomplete or inaccurate information.
Routes and navigation. The routes shown by the Service, including the one calculated for wheelchairs, come from external mapping and routing providers and are indicative in nature. They do not guarantee the route is free of obstacles, stairs or roadworks, or that it is passable at the time of the visit. When no accessible route exists between two stops, the Service warns of this and shows the walking route as an alternative: it is up to the User to judge whether it is passable for them.
The navigation links to the device's maps app and the exported GPX files are provided for convenience. Their operation depends on third-party apps unrelated to WayFy and subject to their own terms. The User must always pay attention to actual on-the-ground conditions and signage, ahead of any indication from the Platform.
7. Rules of conduct
The User agrees to make diligent use of the Service and, in particular, not to:
- Publish false or deliberately misleading accessibility information.
- Harass, threaten, discriminate against, or impersonate other users, whether through chat, comments, or any other social feature.
- Use the Platform for commercial or advertising purposes, or to send unsolicited communications ("spam"), without WayFy's express authorisation.
- Attempt to access third parties' accounts without authorisation, or breach the Service's security measures by any means.
- Reproduce, distribute or commercially exploit WayFy's Content or software without express written authorisation.
- Use robots, web crawlers ("scrapers") or other automated means of mass data extraction without prior authorisation.
Breach of these rules may result in removal of the affected Content, temporary suspension, or permanent cancellation of the account, depending on the severity of the breach, following assessment by the Platform's administration team.
8. Intellectual and industrial property
The design, interface, logos, trademarks, source code and, in general, all of WayFy's own content not covered by user-generated Content, are protected by intellectual and industrial property rights owned by WayFy or by third-party licensors. Their reproduction, transformation or distribution without express written authorisation is prohibited.
OpenStreetMap's cartographic data is used under the ODbL licence, and its use is subject to the terms of that licence regardless of the provisions of this document.
9. Service availability
WayFy will use reasonable means available to it to ensure the availability and proper functioning of the Service, although it cannot guarantee uninterrupted or error-free access. WayFy may temporarily interrupt access to the Service, in whole or in part, to carry out maintenance, update or improvement tasks, seeking to minimise inconvenience to the User and without this giving rise to any right to compensation.
During such tasks, the Service may activate a maintenance mode that replaces the Platform with an informational screen, indicating the expected end time when known, and reserve access to administration staff. Likewise, new account sign-ups may be temporarily suspended.
Certain features depend on third-party services (mapping, routing, image storage, AI assistant, social media). Their unavailability, changes to their terms, or their usage limits may degrade or interrupt the affected feature without this constituting a breach on WayFy's part.
10. Limitation of liability
The Service is provided "as is" and "as available". To the fullest extent permitted by applicable law, WayFy will not be liable for direct, indirect, incidental or consequential damages arising from: (i) inability to access or use the Service; (ii) inaccuracy of accessibility information published by third parties; (iii) Content published by other users; (iv) misuse of the Service by the User; (v) loss of the encrypted chat's unlock methods and the resulting loss of message history; or (vi) unavailability or malfunction of third-party services integrated into the Platform. Nothing in this clause limits WayFy's liability in cases where the law does not permit its exclusion or limitation, in particular in cases of wilful misconduct or gross negligence.
11. Account deletion
The User may request deletion of their account and associated personal data at any time from the My profile → Danger zone section, or by writing to soporte@wayfy.es. The request requires double confirmation to prevent accidental deletions. Once processed, identifying personal data is permanently erased. Reviews, photographs and approved places the User has contributed to the community may be kept dissociated from their identity, as they constitute information of public use to the rest of the map's users.
Closing the account also deletes the chat cryptographic material associated with it, meaning encrypted messages the User exchanged permanently stop being readable, in accordance with clause 5.
12. Changes to these Terms
WayFy may amend these Terms at any time to adapt them to regulatory or technical changes or to changes in the Service itself. Substantial amendments will be notified to the User by email or via a prominent notice on the Platform at least 15 days before they take effect. Continued use of the Service after such amendments take effect will constitute acceptance of the new Terms.
13. Severability
If any clause of these Terms is declared void or unenforceable by a final decision issued by a competent authority, that clause will be deemed not to apply, without affecting the validity and effectiveness of the remaining provisions.
14. Applicable law, jurisdiction and contact
These Terms are governed by Spanish law and, where applicable, by European Union law. For the resolution of any dispute arising from the interpretation or performance of this document, the parties submit to the courts of the User's domicile when the User has consumer status, or to those of WayFy's domicile in all other cases, without prejudice to any mandatory jurisdiction that may apply.
